We should drastically object to inhumane acts in Afghan, from the viewpoint of humanity as well as beyond the kinship of the same Korean race as me, where our pure Korean civilians, among whom Bae Hyung-kyu and Shim Sung-min were killed in part after kidnapped, confined and threatened, are being the victims and hostages, of the Afghani civil and outer wars as the countertraded.

우리의 핏줄이 아프간에서 무고하면서 납치, 구금되어 협박당하고 일부 배형규와 심성민 등은 살해되었으며, 아프간 내외전의 반대급부의 인질이나 희생물이 되는 것에 동포애를 넘어 인류애에 반하는 자들에 단연히 반대한다.

The kidnappers have breached as follows:
first, according to the Rome Statute of the International Criminal Court, and the Elements of Crimes,
Article 7 (1) (e) Crime against humanity of imprisonment or other severe deprivation of physical liberty,
Article 7 (1) (k) Crime against humanity of other inhumane acts,
Article 8 (2) (a) (i) War crime of wilful killing,
Article 8 (2) (a) (ii)-1 War crime of torture,
Article 8 (2) (a) (ii)-2 War crime of inhuman treatment,
Article 8 (2) (a) (vii)-2 War crime of unlawful confinement,
Article 8 (2) (a) (viii) War crime of taking hostages,
Article 8 (2) (b) (i) War crime of attacking civilians,
Article 8 (2) (b) (ii) War crime of attacking civilian objects, and
Article 8 (2) (a) (vii)-1War crime of unlawful deportation and transfer,

second, according to "Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment",

Article 1
1. For the purposes of this Convention, the term "torture" means any act by which severe pain or suffering, whether physical or mental, is intentionally inflicted on a person for such purposes as obtaining from him or a third person information or a confession, punishing him for an act he or a third person has committed or is suspected of having committed, or intimidating or coercing him or a third
person, or for any reason based on discrimination of any kind, when such pain or suffering is inflicted by or at the instigation of or with the consent or acquiescence of a public official or other person acting in an official capacity. It does not include pain or suffering arising only from, inherent in or incidental to lawful sanctions.
2. This article is without prejudice to any international instrument or national legislation which does or may contain provisions of wider application. and

Article 2
1. Each State Party shall take effective legislative, administrative, judicial or other measures to prevent acts of torture in any territory under its jurisdiction.
2. No exceptional circumstances whatsoever, whether a state of war or a threat of war, internal political in stability or any other public emergency, may be invoked as a justification of torture.

아프간 납치자들은,
첫째, 국제형사법원 로마 실정법의 범죄요소로 규정한
제 7조 (1) (e)항 인도에 반하는 범죄나 다른 육체적 자유를 박탈하고,
동법 제7조 (1) (k)항 다른 비인도적 행위를 저지르고,
동법 제8조 (2) (a) (i)항 고의적 살인의 전쟁범죄를 범하고 ,
동법 제8조 (2) (a) (ii)-1항 고문의 전쟁범죄를 범하고,
동법 제8조 (2) (a) (ii)-2항 비인도적 처우를 하고,
동법 제8조(2)(b))(i)항 위반해 민간인을 공격하였으며,
동법 제8조(2)(b))(ii)항 위반해 민간인 대상으로 공격하였고,
동법 제8조(2)(b))(iv)항 위반해 상해, 살해하였으며,
동법 제8조(2)(a)(vii)-2항 위반해 불법 구금하고,
동법 제8조(2)(a)(viii)항 위반해 인질로서 가두고 불법으로 강제이송 구금하였으며,

둘째, 고문과 기타 잔인하고 비인도적이거나 인간을 비하하는 처우나 처벌에 대한 협약 제1조는,
그 협약의 목적으로서 용어 “고문”을 심각한 고통이나 고난이 그것이 육체적이든 정신적이든 그나 제3자로부터 정보나 자백을 얻는 것과 같은 그런 목적을 위해서 그나 그 3자가 범한 행위를 처벌하거나 그나 제3자를 협박하거나 강요하거나 어떠한 이유로든 어떠한 종류의 차별에 기초하고 있든지 간에 그 같은 경우의 고통과 고난이 공적 역할에 있는 공적 관리나 다른 사람의 교사로든 혹은 교사에 의하든지 혹은 그의 동의나 묵인을 했을 때, 행해지는 행위라고 정의하고 있다.
그리고, 동법 제2조의 제1항에 의하면, 그 당사국은 그 관할내 어떤한 영토내에 고문의 행위를 방지할 유효한 법적이고 행정적이며 사법적이거나 다른 조치들을 취해 한다. 동법 제2조 2항은 전쟁의 상태나 전쟁의 위협이나 내부 정치적 불안정이나 어떠한 다른 공공의 비상상태가 일어나게 될지라도 고문을 합리화 시킬 수는 없다고 한다는 것을 위반하였다.

The International Criminal Court, the Office of the High Commissioner for Human Rights (OHCHR), and all international and national organizations, of human rights must condemn them for their cruel conducts like unjust killings, and take all legal and military proceedings including international cooperations, to lose no more civilian lives with the best carefulness, and to set the hostage-taken Koreans at liberty without condition, delay and hesitation, as soon as possible, feeling the gravest responsibilities of the humanitarian respect for the only life .

국제형사법원, 유엔 고등인권판무관실과 모든 국내외 인권단체는 그들을 규탄해야 하고, 최선의 주의를 다해 더 이상 시민의 생명을 잃지 않고, 유일한 생명의 인도적 존중이라는 최고 숭고한 책임을 통감하면서, 한국인 인질의 자유를 찾도록 즉각, 무조건, 지체와 망설이지 않고 국제공조를 포함해, 법적이고 군사적 절차에 들어가야 한다.


It shall be noted that if all the countries as well as the neighborhood of Afghanistan like Pakistan would not report the kidnappers on purpose, sheltering them and helping them escape from arrests after having crossed their borders, they should be considered to be quite alike the aiders and abetters of their crimes, and so that they should not commit the crimes, obstructing the courses of clearing them out through international cooperations.

파키스탄 등 아프간 인접국과 그 외 다른 모든 국가들은 월경한 납치자를 고의로 숨겨주고 체포치 못하게 도주를 도우고 하여 신고하지 않음은 동일한 범죄를 저지르는 것과 마찬가지임에 국제공조와 범죄자 소탕을 방해하면서 그런 범죄의 교사범 내지 방조범이므로 그런 범죄를 저지르지 않도록 주의시켜야 한다.

Right now, those that are loving human rights and peace must cope with punishing their illegal and atrocious war crimes thoroughly.

바로 지금, 인권과 평화를 사랑하는 이들은 이제 그들을 비인도적 행위에 적극 대응하고 나서야 한다.
